Do I need to register in BDO if my company is not based in Poland?

Yes. BDO obligations may apply even if your company is not established in Poland. What matters is whether you place products in packaging on the Polish market.

There is no minimum threshold — BDO obligations arise from the very first delivery to Poland. However, if the total weight of packaging does not exceed 1,000 kg per year, you may benefit from an exemption from variable fees. In such a case, your obligations are limited to paying the fixed fees, maintaining records and submitting annual reports.

Yes, in most cases. Using Amazon FBA in Poland means that your goods are stored in Poland, which may trigger BDO registration — even if you do not sell directly to customers in Poland. Polish regulations impose a BDO obligation on businesses that introduce packaged products to the Polish market. Intra-Community acquisition of goods is also treated as introducing to the market. Therefore, a transfer of goods to an Amazon warehouse in Poland for storage purposes is considered introducing packaged products to the Polish market. At the same time, the regulations provide for an exemption from the BDO obligation if the packaged products introduced to the Polish market are subsequently brought out of the country. However, the products must be shipped out of Poland within the same calendar year. Otherwise, the exemption does not apply. As a result, 99% of Amazon sellers who have active storage in Poland are subject to the BDO obligation, even if they do not sell to customers in Poland.
